On February 4, 2015, in connection with the death of a military conscript in / unit 89547, Gudelev Mikhail Sergeevich visited military unit 89547 stationed in the Chebarkul garrison of the Chelyabinsk region.

During the conversation, it was established that upon the death of Private Gudelev M.S. carried out: from the side of the command service check; on the part of the prosecutor's office, a check on the safety of life and health of servicemen and the military investigation department is conducting a preliminary investigation in a criminal case against the platoon commander of the first motorized rifle company Gorodner A.A., who was charged under paragraphs "a" and "c" h .3 st. 286 of the Criminal Code of the Russian Federation (abuse of official powers, committed with the use of violence or with the threat of its use and with the infliction of grave consequences) in relation to the deceased Gudelev M.S. and p. "a" Art. 286 of the Criminal Code of the Russian Federation in relation to another soldier, Private Kh.

According to the participants of the meeting, the grounds that the death of Private Gudelev M.S. occurred as a result of a murder, not suicidal actions, no, although all versions of what happened will be checked during the preliminary investigation. In particular, such a conclusion can be drawn when studying Gudelev’s email correspondence with friends, where he writes, “that after the shooting he found a cartridge, cleaned it of prints and hid it in the barracks, in case everything was enough, but the weapon is still often received.”

In addition, the command reported that from January 2 to January 4, 2015, Gudelev was on leave, in connection with the arrival of his parents on the occasion of his mother's birthday, after the departure of his parents from January 5 to 7, 2015, he was in the medical unit, due to illness ORZ, he came to the company healthy, did not complain about anything. The daily physical examinations of the platoon servicemen did not reveal any signs of beatings on Gudelev and his colleagues.

Also during the meeting, it was established that Senior Lieutenant Gorodner A.A. he commands a platoon for only a month and a half, before being drafted into the RF Armed Forces, under a contract, he served in the Main Federal Penitentiary Service of the Russian Federation in the Chelyabinsk Region, although he has a higher military education (he graduated from a tank school). Prior to this, for a long time, the junior sergeant acted as a platoon commander - a conscripted serviceman who knows more about the state of the platoon than an officer.

In addition, the WCO went to court with a petition for the election of the accused Gorodner A.A. preventive measures - detention, but the Magnitogorsk garrison military court denied this petition, this decision was not appealed on appeal.

All soldiers are dressed and shod in uniform, uniforms are new. Representatives of the HRC and the PMC were given the opportunity to talk with Gudelev's colleagues in the absence of commanders and other persons. As a result of the survey, no complaints about living conditions were received.

However, when examining two "kubricks" on the first floor of the soldier's hostel No. 7, violations of the sanitary condition of the bathrooms were revealed. Representatives of the command received an explanation that the maintenance of buildings is carried out by Oboronservis.

Also, when visiting the canteen, questions arose about the quality and organization of catering by an outsourcing company.

Questions were verbally voiced to representatives of the military prosecutor's office of the Central Military District and the military prosecutor's office of the Chebarkul garrison. Changing the status of this housing is within the competence of the Minister of Defense of the Russian Federation, in connection with which the complaints of the citizens who applied were accepted for prosecutorial checks by representatives of the military prosecutor's office of the Central Military District, some of the complaints were accepted by the leading consultant of the HRC apparatus in the Russian Federation Prokhorenkov V.A. for consideration in the Office of the Commissioner for Human Rights in the Russian Federation; a number of complaints were accepted by the HRO in the Chelyabinsk region Sevastyanov A.M. to carry out an audit in accordance with its competence.

At the same time, if there are still cases of privatization of housing by servicemen and reserve servicemen on the part of the Ministry of Defense of the Russian Federation, then after the death of her husband, higher officials of the FGKU "Tsentrregionzhilie" of the Ministry of Defense of the Russian Federation in Yekaterinburg and the Department for Housing Distribution of the Ministry of Defense of the Russian Federation do not want to communicate.
Kotenko asks the commissioner to help in the issue of “de-utilization” of the residential premises and the possibility of privatizing it. The appeal was accepted by the Commissioner for Human Rights in the Chelyabinsk Region with the aim of applying to the Ministry of Defense of the Russian Federation to remove the official status from the applicant's apartment and to go to court to decide on the privatization of her apartment.

According to the applicant, she moved into the said apartment with her son on the basis of a warrant issued by the decision of the apartment commission of the sanatorium. This dwelling is in federal ownership, which is currently managed by the Ministry of Defense of the Russian Federation.
In accordance with the Decree of the Head municipality"Chebarkul city district" dated November 25, 2008 No. 1100, taking into account the order federal agency on Federal Property Management dated June 30, 2008 No. 749-r “On the gratuitous transfer of federally owned property, assigned on the basis of the right of operational management to the Chebarkulsky apartment and operational part, to the ownership of the Chebarkulsky City District municipal formation, residential premises, located in multi-apartment residential buildings No. 26 and 44, transferred in the prescribed manner to the ownership of the district according to the list.

Alexey Sevastyanov, Commissioner for Human Rights in the Chelyabinsk Region, comments on the situation:

“A system error has occurred. It was laid down initially when allocating housing to military personnel. Then, due to this systemic error, citizens were evicted from housing, the warrants were declared invalid, and other measures were taken that violated the rights of citizens to housing. There have been many such requests. We are preparing a special opinion together with Ella Pamfilova, Commissioner for Human Rights in the Russian Federation, sending a request to the Ministry of Defense of the Russian Federation and issuing a special order.
A similar practice in the Russian Federation has already been carried out on the example of military unit 90600, which is deployed in the military camp of the Roshchinsky garrison, 30 km from Samara, where those who received official housing received the right to privatization. The housing stock in the Chebarkul military town was not transferred to the municipality, citizens cannot exercise their right to privatization. An immediate response is required, as people have not been able to exercise their rights for 15 years.
The city, which was previously closed, becomes a "hot" spot. In fact, people living in the city are divided into two castes: those who were able to exercise their right to privatization, and those who were deprived of this right. All these contradictions resulted in a sharp discussion, we practically observed the situation of "serfdom". In the 21st century, such things are unacceptable.”

After applying to the military prosecutor's office and investigating this incident, the unit commander was transferred to another unit in Tajikistan for a disciplinary offense.

No one else was punished for the injury caused to the serviceman.

Lawyers were able to defend the rights of the victim: moral damages and compensation for loss of earnings were recovered in court.

As a result of a craniocerebral injury, the guy remained disabled, suffers from memory loss, and is unable to work. For 9 months he could not remember what happened to him. Now he is undergoing rehabilitation in the Chelyabinsk military hospital.

Valentina Pavlovna, mother of a serviceman: “My son served honestly, got injured. Became disabled. Now he is not able to earn an apartment. He has the right by status as a combat veteran to receive an apartment. The state is obliged to protect the rights of military personnel. I am simply surprised by such a boorish attitude towards their citizens on the part of the Ministry of Defense of the Russian Federation, which is obliged to protect them. The actions of the Ministry of Defense undermine the authority of the army. The attitude towards the army among citizens is already “below the plinth”. Who will go there to volunteer if the Department of Defense behaves like this? Protects the interests of the department, not the citizens? I appeal to the Commander-in-Chief, Vladimir Vladimirovich Putin, with a request to take us under his protection.”

Lawyer Alexei Kovalev comments on the situation:

“According to the materials of the case, the actions of the Ministry of Defense in conducting a trial with endless appeals against court decisions violate the right to a fair trial. It is necessary that insurance payments be started as soon as possible for a citizen, because he needs to live on something and continue rehabilitation. Secondly, it is necessary to solve the housing problem. The rights of a serviceman must be fully restored, because we are talking about justice, trust in authority state power and the military department.

I want to point out three things that are worth paying attention to in this case.

Firstly, no one has been held really responsible for concealing objective information about the incident; the opposition of the Russian Defense Ministry continues in relation to the mother and the soldier in defense of his rights. This is not the first time that we have encountered when the facts of injuries and tragic incidents are being suppressed or presented in a different light by the Ministry of Defense.

Secondly, the administrative machine of the Moscow Region is designed in such a way that each of its bodies, by simple manipulation, shifts responsibility onto each other. An indicator of this cynicism is the consideration of this case in court, when lawyers declare that the Moscow Region is an improper defendant, and offer either a military unit or Cossacks as a defendant, because the name of the unit contains the word “Cossack”.

The bottom line is that the Ministry of Defense is appealing the court decision, which the victim in the case has been seeking for a long time. It is doubly sad that no one from the Ministry of Defense bothered to personally communicate with the mother of a soldier who actually suffered due to military service, and only two lawyers make decisions by proxy, which undoubtedly undermines the authority of the authorities and the rule of law.

I appeal to Minister of Defense Shoigu with a request to withdraw the complaint against the decision of the court of first instance and I ask the responsible persons to do everything possible to resolve the conflict, and not fight with citizens.

Thirdly, there are not so many lawyers working in the military industry. According to lawyer Kovalev, there are already threats against him from the Ministry of Defense that lawyers will do everything to counteract his practical activities to protect the rights of citizens. This position is puzzling and is a violation of the right to exercise professional activity.

2. Inspection and detour of the medical unit 71316 was carried out:
15 servicemen are undergoing treatment and examination, of which 8 people are drafted in spring-summer 2012 and 7 people are drafted in autumn-winter 2012. Of these, 10 people lie with colds; 2 - with surgical diseases; 3 - in rehabilitation after acute bronchitis. 16 servicemen are being treated at the district military hospital in Yekaterinburg, 7 of them with pneumonia, 7 with other colds;
2 people - in psychiatry, and in the Armed Forces of the Russian Federation they are already called up with existing diseases, which indicates the improper performance of the duties of the draft boards.

According to the results of the conversation with the soldiers who are being treated in the medical unit: there are no cases of hazing in the unit, they are fully provided with all types of allowances, pneumonia occurs, but the sick are immediately hospitalized.

The doctor of the medical center employee Yesin A.A. in a conversation, he explained: that the first-aid post of the unit is provided with a mobile X-ray, therefore, when the body temperature rises above 37 degrees, all military personnel undergo X-rays to detect pneumonia, and if it is detected in the park of the unit, a car is in constant readiness that takes sick soldiers to the hospital, while the temperature of the military in the winter is constantly checked. In addition, twice a week on Tuesday and Thursday, soldiers complaining of health conditions are taken to the hospital for consultations with specialist doctors. With regard to the serviceman S. Karabatov, the doctor of the medical center explained that the latter had been diagnosed with pneumonia in a timely manner and he was immediately sent for inpatient treatment to the Chelyabinsk garrison hospital, and then to the district hospital in Yekaterinburg. He believes that the latter died due to a weakened immune system.

In the cases of the death of Glebov and Karabatov, no “fatal” violations on the part of officials of the military units regarding the untimely provision of medical assistance to military personnel were revealed by the audit. My brother, Maksim Yuryevich Tyumentsev, has been serving in military unit No. 89547 of the Chebarkul garrison of the Chelyabinsk region since December 2010 in an engineer company. In the summer of 2011, he was at the Azov training ground, where they disposed of shells and prepared for the international exercises Center-2011.

During the service in this unit, my brother managed to experience all the inhuman tortures that are only possible in our time - from the disposal of shells, constantly being in a state of severe stress from the possibility of "flying into the air" at any moment, to beatings, humiliation and outright bullying from commanders and contract sergeants such as KUFILDOV and PATYSEV.

In this military unit, conscript soldiers are like in a concentration camp, where the same Dagestan soldiers act as overseers and inquisitors. All this provision exists with the encouragement of the commanding staff of the unit and the connivance of the military prosecutor's office of the Chebarkul garrison.

Almost all conscript soldiers at the Azov training ground were mocked, except for the “Dagestanis”, they are in a special “honorable” position. My brother was forced to carry a bag full of gravel on him for three weeks, and he carried it everywhere - to the toilet, to the dining room, ate and slept in it, after which he had serious problems with his spine.

They beat him in such a way that 8 teeth were knocked out of his brother, he had a severe concussion (so that he saw double) after beating him with handcuffs on the head, his nose was broken. They beat me with sticks in the kidneys and liver. There was only one reason for the beatings - they extorted money that the guys received for the disposal of shells - the amounts are very rather big, since 35 thousand rubles a month were charged for this work.

While the cards were in the custody of the commanders, money mysteriously disappeared from them, since PIN codes were also stored along with the cards.

As a result of unsanitary conditions and field “feeding”, my brother developed periodontal disease. Probably, after such a service, he will not have a single tooth left at all, and at the age of 24, his brother will have to insert new jaws.

Because of bullying and humiliation, which it was no longer possible to endure, Vyacheslav Tikhonov, a colleague of my brother, tried to commit suicide, as a result of which he ended up in a psychiatric clinic in the village. Birgildy.

My brother went to serve at the age of 24, strong, healthy, after graduating from a technical school. Before the army managed to get a family. He has a one year old daughter. 3 months left to serve. He had the intelligence and courage not to commit suicide, but to escape from this concentration camp, called a military unit.

THE THREAT TO HIS LIFE WAS ABSOLUTELY REAL.

After he arbitrarily left this “unit”, his company commander repeatedly called me on a cell phone and threatened “that he would be found dead in a ditch if he did not return to the unit.”

Having learned about the incident, I came from Asha, found my brother and turned for help and justice to the military prosecutor's office of the Chelyabinsk garrison and the military investigation department, where the investigation into these facts is currently underway.

My brother underwent a forensic medical examination in Chelyabinsk on the street. Varnenskaya, 4, the beatings were removed. The civilian doctor-expert was very surprised that my brother, in such a state, was not immediately admitted to the hospital. He was also sent to undergo a military medical examination for suitability for further service in the hospital of Chelyabinsk, Sverdlovsky pr. 28, where they did not notice any concussion, no damage to the spine, no fracture of the nose (fracture of the bones of the skull), or other injuries.

The only thing that was the result of the examination was a referral for inpatient examination and treatment to the same psychiatric hospital, where many of Maxim's colleagues had already visited, i.e. the next torture in a psychiatric hospital.

My brother's wife Balyberdina Valentina Andreevna, with her one-year-old daughter, specially rented an apartment and lived next to her brother's place of work - in the DOS of Chebarkul. After Maxim escaped from the unit, she began to receive threats by phone, colleagues began to come home - unknown to her personalities in military uniform, who searched a rented one-room apartment 3 times a day, and who repeatedly threatened her, “that if her husband does not return to the unit, then she will have to“ REPLY TO THE MOTHERLAND ”BY RAPE. Before being drafted into the army, my brother had health problems - a stomach ulcer, which “cured” during the military draft commission. Since the brother was unable to receive any medical assistance at the place of service, he was forced to independently get to the city of Miass, where he was examined in City Hospital No. 2 gastrointestinal tract and diagnosed with: duodenal ulcer, atrophic gastroduodenal reflux, chronic cholecystitis. He also underwent an X-ray of the cervical spine with a diagnosis of cervical osteochondrosis.

These medical documents are in Maxim's hands. How long will it be possible that instead of training in military specialty in the Chebarkul garrison, soldiers will be as slaves taken prisoner Russian Army? The official army media first spoke about the expansion of the Chebarkul formation back in February 2016, when the commander of the Central Military District, Colonel-General Vladimir Zarudnitsky, announced the modernization of the organizational and staffing structure of the Central Military District due to the increased intensity of combat training and new tasks assigned by the federal authorities to the district. As part of this modernization, for example, the Kant air base located in Kyrgyzstan will become the basis of a unified structure, which will include all, in principle, Russian units in this state, the 201st military base in Tajikistan will become a brigade. Already in 2015, a new mountain motorized rifle brigade was formed in Tyva, and an anti-aircraft missile regiment in Khakassia. The district command plans for 2016 include the formation of two military formations, one of which will be based on Chebarkul tankers.

Military and regional officials do not see any disadvantages in deploying a division in Chebarkul.

Vice-Governor Oleg Klimov claims that the region will not have to invest in additional infrastructure for Chebarkul tankers, all expenses will be borne by the military department. Finally, none of the supporters of the formation of the brigade mentions another negative factor - the criminal situation associated with the concentration of the military. So, in June and November 2013, three conscripts died here from transient pneumonia, in January 2015 conscript Mikhail Gudelev shot himself (the criminal case on the fact of his death is still pending in court, the defendant is the former platoon commander of the deceased Vladimir Gorodner). 2016 was marked by two deaths at once: in April, during exercises at the Chebarkulsky training ground, Pavel Ostapovich died under the caterpillars of an infantry fighting vehicle, and in August Nikita Nedelko died in the Yekaterinburg military hospital, according to the official version, he was injured by a back wave from a shot from an anti-tank grenade launcher.

“We must not forget about suicide. Over the past five years, around half a dozen suicides can be counted throughout the Chelyabinsk region, mostly by contract soldiers and even officers. Moreover, the checks unequivocally confirm: the cause of suicides is domestic. Debts, disorder, lack of housing. And in last years we tend to increase "criminal" corpses: in 2014 we did without them, in 2015 one Mikhail Gudelev died, in eight months of 2016 we already have two corpses - Ostapovich and Nedelko. My experience says that this happens, firstly, due to relaxation, complacency and, as a result, the lack of attention on the part of commanders to the needs of soldiers, and secondly, due to the fact that officers are not actually afraid of responsibility. The defendant in the criminal case of the crushed BMP Ostapovich is the same green driver, and no one is in a hurry to bring to justice the one who made this wild situation possible at all, who taught the soldiers that it is permissible to click their beak during the exercises! The same situation is now unfolding with Nedelko: a careless grenade launcher, and not the officer who was not convinced of the safety of live firing, will be blamed for his death. And now we will increase all this number of suicides, guys who died through negligence, "runners" and others in proportion to the growth in the number of personnel from the brigade to the division. Not scary?"

Note, according to the investigating authorities, this year there were not two, but three criminal corpses in uniform in Chebarkul - just the body of the player of HC Zvezda Igor Aksenov, who served in Chebarkul and disappeared at the end of April, was not found. Recall that Aksyonov asked for time off from the command to participate in the match, hit the road and disappeared.
